DPAP Issues Permanent Authority for Use of Simplified Acquisition Procedures Exception for Certain Commercial Items (FAR Subpart 13.5)

Editor’s Note: FAR Subpart 13.5, formerly known as the Test Program for Certain Commercial Items, permits agencies to conduct procurements using Simplified Acquisition Procedures that exceed the traditional $150K threshold. The exception allows agencies to make buys valued up to $6.5M when this exception is applied.

2015-O0004: Permanent Authority for Use of Simplified Acquisition Procedures for Certain Commercial Items

Expiration Date: until incorporated in the FAR or otherwise rescinded.

Affects: FAR 13.500(d) FAR 13.500(d) states that the authority to issue solicitations under FAR subpart 13.5 expires on January 1, 2015. Because section 815 of the FY2015 NDAA makes the authority permanent, this class deviation instructs Contracting Officers to disregard FAR 13.500 (d) in its entirety, including this expiration date.
